1. Acceptance of Terms
By accessing and using the services provided by Growth Coach Canada, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our personal growth coaching services, including all legal and tax advisory components offered in Canada.
If you do not agree to abide by the above, please do not use our services. Your continued use of our services constitutes acceptance of these terms and any modifications thereof.
2. Service Description
Growth Coach Canada provides comprehensive personal development coaching services combined with legal and tax advisory guidance specifically tailored for Canadian residents and organizations. Our services include:
- Individual personal growth coaching sessions
- Group workshops and training programs
- Legal compliance advisory for coaching practices
- Tax planning and optimization guidance
- Career transition support services
- Corporate training and development programs
All services are provided in accordance with Canadian federal and provincial regulations applicable to coaching and advisory services.
3. Client Responsibilities
3.1 Accurate Information
Clients must provide accurate, complete, and current information when engaging our services. This includes personal details, financial information relevant to tax advisory, and any legal considerations that may impact the coaching relationship.
3.2 Active Participation
Success in personal growth coaching requires active participation and commitment from the client. Clients are expected to attend scheduled sessions, complete assigned exercises, and engage honestly in the coaching process.
3.3 Compliance with Recommendations
While we provide legal and tax guidance, clients remain responsible for ensuring compliance with all applicable Canadian laws and regulations. Clients should consult with independent legal and tax professionals for complex matters.
4. Professional Standards and Limitations
Our coaching services are provided by qualified professionals adhering to industry standards. However, clients should understand the following limitations:
- Coaching is not a substitute for medical, psychological, or psychiatric treatment
- Legal guidance provided is informational and not a substitute for independent legal counsel
- Tax advisory services are supplementary to professional accounting services
- Results from coaching cannot be guaranteed and depend on individual commitment and circumstances
Important: If you are dealing with mental health issues, substance abuse, or other serious personal challenges, we strongly recommend seeking appropriate professional medical or psychological support in addition to our coaching services.
5. Payment Terms and Refund Policy
5.1 Payment Schedule
Payment for services is due according to the agreed schedule outlined in your service agreement. We accept various payment methods and provide clear invoicing for all services rendered.
5.2 Cancellation Policy
Clients may cancel individual sessions with at least 24 hours notice without penalty. Cancellations made with less than 24 hours notice may be subject to a cancellation fee as outlined in your service agreement.
5.3 Refund Policy
Refunds are considered on a case-by-case basis. For program cancellations made within 7 days of purchase and before the second session, a partial refund may be available. All refund requests must be submitted in writing and will be reviewed according to our refund evaluation criteria.
6. Confidentiality and Privacy
We maintain strict confidentiality regarding all client information shared during coaching sessions and advisory consultations. Our privacy practices are detailed in our Privacy Policy, which forms an integral part of these terms.
Client information is protected according to Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.
7. Intellectual Property
All materials, methodologies, assessments, and content provided during coaching sessions remain the intellectual property of Growth Coach Canada. Clients may use provided materials for personal development purposes but may not reproduce, distribute, or commercialize any proprietary content without written permission.
8. Limitation of Liability
Growth Coach Canada's liability is limited to the fees paid for services. We are not liable for any indirect, consequential, or punitive damages arising from the use of our services. This limitation applies to the fullest extent permitted by Canadian law.
Clients acknowledge that personal growth and business development involve inherent risks and that outcomes cannot be guaranteed regardless of the quality of coaching provided.
9. Termination of Services
Either party may terminate the coaching relationship with written notice. Termination does not relieve clients of their obligation to pay for services already rendered. Upon termination, all confidentiality obligations continue to apply.
We reserve the right to terminate services immediately if clients violate these terms, provide false information, or engage in behavior that is harmful or disruptive to the coaching process.
10. Governing Law and Dispute Resolution
These terms are governed by the laws of the Province of Ontario, Canada, and federal Canadian law where applicable. Any disputes arising from these terms or the provision of services will be resolved through:
- Initial discussion and good-faith negotiation
- Mediation through a qualified Canadian mediator if negotiation fails
- Binding arbitration under Canadian arbitration rules if mediation is unsuccessful
11. Modifications to Terms
We reserve the right to modify these terms at any time. Significant changes will be communicated to clients with at least 30 days notice. Continued use of our services after modifications constitutes acceptance of the updated terms.
Minor administrative updates may be made without prior notice, and clients are encouraged to review these terms periodically.
